What observations to add in the Certified Report Energetic

Energy Certificate Report and its observations. A key point.

At the time, some time ago -January- we published a post regarding the observations in the Certified Report Energetic, but we have been expanding such information taking into account current events and it seems to us consistent, and in our judgment responsible to share such Information with Certifying Technicians to offer a stronger Energy Efficiency Certificate.

I think that all Certifying Technicians should understand that the drafting of the Energy Certificate implies give "attest" to a series of characteristics that fall on a determined property. Where the Technician who signs such Document assumes a series of responsibilities both before our client as well as with the pertinent Administrations. Where the section of the observations energy certificate acquires its importance.

At this point, we should include a series of Observations -in our opinion- that support the coherent and professional writing before possible actions legal by our client or other entities…. What observations to add in the certificate report energetic?

Observations report Certificate Energetic:

1.- A section that I think is important and in the latest version of the CE3X program (In the Label) a phrase that may interest us has disappeared (In the CE3 I think it no longer appears either) since the programs for existing buildings are calculated based on a Standard Rating. It would add:

“It is observed that the Energy Consumption and its Carbon Dioxide emissions are those obtained by the Program …….., for normal conditions of operation and occupation. The actual Power Consumption of the Building and its Carbon Dioxide Emissions will depend of the operating and operating conditions of the building and weather conditions, among others factors.”

*Remember that in the Decree 47/2007 intended for New Construction, was obligatory compliance that appears (Annex II. Point 5)

2.- The only way to identify a property is via Cadastre, given that our client did not provide us with any Registry Document, contemplating two cases:

2.1.- Cadastral Ref. is from the matrix or their data:

“It is observed that there are discrepancies between the physical reality of the property and the data provided according to the Cadastral Ref. indicated in this Report, regarding the description and/or location, which does not lead to doubts about its identification or characteristics and that do not influence foreseeably on the securities issued in the present Certified.”

2.1.- We do not have or cannot obtain the Ref. Cadastral:

“It is observed that it has not been possible to know the cadastral reference of the property nor has it been possible to obtain data cadastral records of the same by telematic consultation to the Office Virtual Cadastre.”

3.- Customer data:

“It is noted that the information attached in the section of "Customer Data" of this Report are those provided orally by the Registered Owner of the property.”

4.- With reference to the shadow pattern, given that the data collection will be generic:

“It is observed that the “Shadow Pattern” considered for the purposes of this Report is referring to the best approximation that it has been possible to obtain the Assistant Technician of the Energy Certification process of Buildings for the analyzed typology. Limited only to a generic data collection of the environment.”

5.- Regarding the proposed improvements, I think that it is important that consistent values appear. An example would be those provided in the CE3X program:

“It is observed that the proposed improvements and the generic items of construction costs adopted in economic analysis for an increase in the possible improvement in your rating are indicative. Based in data that have been extracted from specialized magazines, taking into account its location, current market situation, typology and qualities available to the property Certify.”

6.- Regarding the visit (To whom applicable):

“It is observed that the Competent Technician or Technician Assistant to the Energy Certification of Buildings process who signs this Report is not responsible for the possible existence of hidden defects, alterations in the facilities and construction of the property, which could affect the qualification expressed in the Report. The data obtained from the verifications of the property in the present report have been limited to an inspection only eyepiece of the same “in situ”.”

7.- Another observation to add that we should have into account is the validity period of the Certified Report Energetic according to:

“It is noted that this Report has a maximum validity of 10 years, counting, according to the requirements established by the competent body of the Community Autonomous in terms of energy certification of buildings. That they determine the specific conditions to proceed with their renovation or update.”

8.- Observation regarding the Assistant Technician “Assistant technician”:

“It is observed that the data collection during the visit practice "in situ" on the property to be certified is collected by the Assistant Technician of the Energy Certification process of Buildings whose figure is described in the Royal Decree 235/2013, April 5, which approves the procedure basic for the certification of the Energy Efficiency of buildings.”

“It is observed that the data adopted in the present Report for the drafting of the Energy Efficiency Certificate are those provided by the technical assistant of the process of Building Energy Certification.”

9.- “Signatures” of the competent Technicians, yes proceeds:

“It is noted that this Document will not have legal validity, civil, administrative or any other nature if the signature of the "Competent technician" and the "Assistant technician of the process of Energy Certification of Buildings" both Technicians described in Royal Decree 235/2013, April 5. Figures involved in the energy certification process of buildings that embody the present Document.”

10.- Observation of the “Record”

"It is observed that both the" Technician competent" as the "Assistant technician of the process of Energy Certification of Buildings" is not responsible, neither in the present, nor in the future of the enforceable conditions both legal, economic or of any other nature that determine the Autonomous Communities for the Registration of Certificates of Energy Efficiency as established in the Royal Decree 235/2013, April 5, which approves the procedure basic for the certification of the Energy Efficiency of buildings in the Third Transitory Provision. Register of Energy Efficiency certificates.”

11.- Observation of the "Energy Price" In the case considered in the Report.

“It is observed that the Energy Prices adopted in the economic analysis of this Report are related to net. Without any application of taxes on the energy, taxes, VAT…etc.”

12.- Observation of Property without Facilities.

“It is noted that the property to be certified in the This Document does not have the minimum facilities to carry out the correct certification of efficiency energy of buildings. adapting an assumption with average values, estimated necessary to meet the energy demand of the property in about normal operating conditions and occupation.”

13.- We must observe those calculations assumed by the Technician representing an action not included in the Program used to write the Certificate Energetic.

The glossary of observations in the Certified Report Contributed energy is of own drafting, according to our experience and with the desire to "cover our backs" before possible legal actions. It would be interesting to be able to compare different opinions about it.
